Should I see a lawyer?
If you are asking this question, you should call our office today. Your initial consultation is free. You will find out if you have a case and we will determine how we can help. It is always worth seeking information. There is no obligation and no risk involved.
How much will it cost for me to hire a lawyer?
There are generally two types of agreements my firm reaches with clients; 1) contingency fee agreements and 2) hourly fee agreements.
Contingency Fee Agreements:
If your case regards a personal injury or workers' compensation claim, I will handle it on a contingency basis. My fee will be a percentage of what I recover for you and is dependent on me achieving and/or collecting on a settlement or judgment. If you have a contingency fee agreement with my office you will not have to pay any attorney fees unless you collect.
Hourly Fee Agreements:
In other areas of law, such as in the case of divorce, your case will more than likely be billed hourly and the total fee will be dependent upon how much time I will need to invest in the case. These hourly cases usually require a "retainer". A retainer is a sum of money which I will hold in an account that is separate from my main business account. I apply my final fee to the amount held in the retainer at the close of your case. The amount of the retainer I will need depends on the number and complexity of issues that we anticipate. For hourly cases, my office will not be taking any action on your behalf until we agreed that I will be representing you and have received your retainer.
What is a statute of limitation? Should I be concerned?
Yes, you should be, if you feel you may want to pursue a legal action. A statute of limitation is the time limit that you have to file a case. The amount of time varies depending on what type of case you have. For example, if there is a two year statute of limitation, and you do not file before the end of the two years, your case may be barred. If your case is barred by the statute it does not matter how strong it would have been had you filed on time. Sometimes the statute of limitations starts from the time you knew or reasonably should have known that you may have a case. To protect yourself, we recommend that you seek legal counsel as soon as possible. Remember, it doesn't cost anything to schedule a consultation with my office.
I need my job. Will my employer be angry if I hire a lawyer? Will I be fired?
It is unlawful for any employer to discharge, lay-off, or take any adverse employment action against an employee for taking advantage of their right to receive Workers' Compensation benefits. Your employer will be liable to lawsuit for both your lost wages and possibly punitive damages if they take an adverse employment action due to your claim. When you are represented by an attorney, your rights are protected.
