In order to ensure that your legal rights are protected, you should seek an attorney at the time you are injured. This is even more important if you are offered a lump sum settlement. By accepting a lump sum settlement, you would probably be waiving any right for further medical treatment and any other rights you may have under the Workers' Compensation Act should your disability increase.
If, on the other hand, you obtain an award through a hearing, you will normally receive a permanent disability compensation payment. You also preserve the right to return to the Commission within 30 months of the Industrial Commission decision if your disability increases. Furthermore, you will be able to receive treatment of your injury for your lifetime.
