What
Kind of “Damages” Are Awarded?
Under the law, surviving
family members are entitled to different types of compensation
depending on the state law implicated.
These can include:
- Medical and funeral expenses
- Compensation for loss of financial
support
- Reimbursement for future services normally provided
by the deceased
- Compensation for loss of love, attention,
affection, guidance and companionship
- General damages
- Punitive damages, where legally appropriate
- If there was
pain and suffering before the death, this can usually be
recovered through a related survival
claim
The court assesses damage awards based upon several factors
which include the relationship of the survivor to the deceased
and the likely potential income of the deceased (had he/she
lived a full life). All life is valuable, even if that person
