Frequently Asked Workers' Compensation Case Questions and Answers!
I was injured at work; what should I do?
Following a work-related injury or illness, an employee should report his injury or disease to their immediate supervisor, foreman, or another person in charge as soon as possible and not later than 45 days following the date of the accident or incident. Your notification should include the date, time, and place of the accident or incident, along with a general description of what occurred. There are several exceptions to this rule; therefore, you should contact an attorney even if you do not believe you gave notice within this period.

It's been a while since I was injured at work. Can I still file a claim?
Time limits do apply for workers' compensation claims. Typically, a claim should be filed no later than three years after the accident or two years after one-stop receiving benefits, whichever occurs later. Special time limits apply for death claims and occupational diseases. However, there are exceptions to these general rules. No matter what has now prompted you to seek support, you deserve to understand your rights and seek compensation if your workplace injury caused lost wages, medical bills, or other losses.
How are Workers' Comp Cases handled in Central Illinois?
The Illinois Workers' Compensation Act and the Illinois Industrial Commission's rules provide for a unique arbitration procedure for all those in the state of Illinois. If your claim cannot be settled, it will be tried by an arbitrator. After the arbitration, either party can appeal the arbitrator's decision to the Illinois Industrial Commission. A panel of three commissioners will reconsider any issues raised in the case. Although it is rare, appeals can then be made to the Circuit Court, the Appellate Court, and the Illinois Supreme Court. McCarron Law Firm works to gain ideal settlements for workers' comp clients throughout Illinois and represents clients in arbitrations and appeals as needed.
